Copyright in a settlement agreement is “standard practice” for attorneys representing victims of nonconsensual pornography, Erica Johnstone, co-founder of the nonprofit legal privacy advocacy group Without My Consent, told Gizmodo. The new lawsuit follows a lawsuit filed last month by Kristy Althaus, Girls Do Porn victim and former runner up for Miss Teen Colorado. In 2014, her Girls Do Porn appearances went viral after appearing on Pornhub and other free porn sites, and she was stripped of her title and faced public shaming while still in college. The website was dedicated to revealing the true identities of the women appearing in those sex videos, “causing the victims to be subjected to severe harassment,” the DOJ said in a press release last year. Pratt’s GirlsDoPorn co-conspirator, Michael Isaac Wolfe, admitted to coercing about 100 “models” between the ages of 18 and 23 into making pornographic videos for their San Diego-based website, which he said would not be shared in the United States.

First lawsuit filing

Wolfe eventually handed off camera duties to other individuals a few years later, and it seems like he, Pratt, and Garcia were all working on recruitment over an extended period of time… Months, maybe even years, during which time, the jobs of each began to blur. For many of the women ensnared by this scheme, the filming of the scene was the worst part. What had originally been promised as 30-minutes would often turn into a several hour shoot, during which time the male performer – oftentimes Andre Garcia – treated the women roughly.

It’s these kinds of videos — uploaded without any verification of the age or consent of those depicted — that now drive Mickelwait’s fight to knock Pornhub out of business. “No platform on the internet has taken the significant steps we have to protect the safety and security of our community,” said Sarah Bain, a spokeswoman for Ethical Capital Partners, a Canadian private equity firm that owns the Pornhub network of adult-content sites. Pornhub, launched in 2007 and based in Montreal, lets users upload amateur and professional porn videos in much the same way users upload to YouTube.

As well as the GirlsDoPorn watermark, the 12 videos hosted on the deepfake website also have a watermark of US company Akool, which offers generative AI services, including a “face-swapping” tool, to marketing professionals. Court documents say the GirlsDoPorn staff recruited victims with “threats of force, fraud and coercion.” Financial records show the websites generated more than $17 million in revenue. The women allege that the producers coerced them into shooting porn by telling them that the videos would only be distributed privately to individual buyers overseas, and that the content would not appear online. The women claim that the footage was then uploaded to the tube site Pornhub, and that they were subject to doxxing and harassment as a result. The suit alleges that Girls Do Porn benefited tremendously off exploiting the women, with its websites generating about $17 million.
